A Marshall lot on the French Broad still has a silt line on the remaining piers and a sycamore against the fence. The channel looks different than the 2023 photo. Two years after Helene, the rebuild question is paper first: floodplain, trout buffer, and who pays to move the wood.

What changed in floodplain maps after Helene?
Check the current map and the floodplain administrator. Helene moved sediment and, in places, the channel. Official maps update on their own cycle. A scar you can walk is not a new FIRM.
Hard-hit river towns with active rebuild demand include Marshall, Lake Lure, Chimney Rock, and Swannanoa. Rental vacancy sat near zero in the eight hardest-hit counties. State recovery funds include about 1.4 billion dollars overall and more than 800 million dollars for single-family repair. Those figures describe a rebuild wave. They do not redraw a floodplain line here.
On a Marshall, NC walk, take the current map printout with you. Compare it to the silt line. If they disagree, the administrator wins, not the silt.
Can you clear to the creek bank?
Not through a designated trout buffer. That strip is 25 ft undisturbed from the top of bank. Trout waters are common across Buncombe, Henderson, Madison, Transylvania, and Haywood. The French Broad basin has no Neuse-style extra width of its own. Protection is the trout rule, local stormwater rules, and forestry BMP zones of about 50 ft on harvest sites.
Helene wood in the strip is still in the strip. A drum that “follows the flood” into that 25 ft is still a machine in an undisturbed buffer. Work from above it. Hand-carry what you must. See Landslide-damaged land if the bank is a scar that ran rather than a flood mark.

Dams over 15 ft or significant hazard still need NC Dam Safety papers and a PE stamp if you are touching a built dam. A creek lot is not automatically a pond job. Do not guess.
Do buyouts limit clearing on the lot next door?
Only with a recorded fact. If a parcel was purchased under a recovery program, that is title on that parcel. Your lot is your lot unless a restriction is on your deed. A vacant, mowed next door is not extra yard you can clear to the water.
Ask the county. Read the record. Then hire storm cleanup on your envelope, not on a rumor about the neighbor.
Who pays, and what paper still applies?
Remaining private-land debris is largely the owner’s cost. FEMA PPDR closed to new applicants on April 15, 2025, after 5,000-plus applications and about 93 percent complete on 4,771 parcels. Public waterway removal finished at about 1.29 million cubic yards. Buncombe right-of-way finished April 2025 at about 1.01 million cubic yards. Buncombe Reduce to Rebuild waived permit fees, with about 400 permits by mid-2026. Mapped floodplain rules still apply. If you grade a pad, you still need ground cover within 21 days of the grading phase. If you disturb an acre or more, file the erosion plan at least 30 days before work.
Retaining walls and slope stabilization are a grading contractor’s scope where a bank was cut or a fill will not hold. Walls over 4 ft in Asheville slope areas are separately regulated. A sandbag aesthetic is not that wall.
Federal nexus projects that may affect northern long-eared bat avoid clearing suitable roost trees April 1 through November 14. A funded rebuild on a creek lot can sit in that window. A purely private chip job usually does not. Ask.
How do you start on a Marshall or Lake Lure creek lot?
Print the current flood map. Flag top of bank. Sort wood versus sediment. Then ask the administrator before you restake. See the rest in the guides library. Lake Lure and Chimney Rock had catastrophic flooding; the same buffer and map rules still apply even when the channel looks new.

Lake Lure and Chimney Rock lots had water through structures as well as through yards. The same map-and-buffer sequence still applies. A rebuilt pier on a guess is a second loss. Print the panel. Flag the bank. Then hire wood.
Sediment fans are not free fill. If you spread them, you may be grading. If you leave them in a trout strip, leave them. If you haul them, you need a place that will take that material. Do not dump a fan on a neighbor’s empty buyout rumor.
Permits fell 38 percent after the storm before the rebuild wave. That dip is over in the towns that are building again. Your creek lot still needs the administrator’s yes.
Marshall’s French Broad lots and Lake Lure’s lake lots share the map problem and do not share the water body. A lake panel and a river panel are different conversations with the same advice: print the current one. Do not rebuild from a 2023 screenshot.
Outbuildings that floated or crushed are demolition plus debris. In Buncombe, demolition routes through the Asheville-Buncombe Air Quality Agency because of asbestos rules. Madison and Rutherford lots have their own desks. Ask before you torch a shed. Household wreckage is not vegetative debris under the Forest Service special permit.
If you restake, stake above the trout ribbon and above the floodplain setback the administrator names. Clearing a pretty bench that sits in both is how you pay to open ground you cannot build. Two years after Helene, the cheap sequence is still paper, ribbon, then wood.
Public waterway crews finished about 1.29 million cubic yards. That number is why the channel looks tended and the Marshall bank on your side still holds a sycamore. Your clearing invoice is not a second waterway contract. It is private wood above a 25 ft trout ribbon, on a floodplain panel you printed this week.
Marshall rebuild is happening on a river that still has a 25 ft trout strip. Lake Lure rebuild is happening on a lake with its own panel. Chimney Rock sits between flood and slope. Walk the administrator who matches the water you actually have. Then hire the wood crew on the envelope that paper allows, not on the silt line you can still see on the piers. Bring both to the walk so the operator sees the ribbon and the map, not the mud stain on the block alone. Marshall lots still have both marks. Use the paper one when they disagree.
