Madison County is state ground. There is no county erosion office, no county slope percentage, and no county fee sheet. The state reviews a plan at 1 acre and the county planning desk handles zoning and the ridge ordinance. That makes Madison simpler on paper than Buncombe and harder in the field, because the French Broad gorge and the Bald Mountains don’t care what the paperwork says. Marshall is about 40 minutes from the Asheville yard on US 25.

Who reviews an erosion plan in Madison County?

The state. DEMLR’s list of delegated local programs, revised May 15, 2025, doesn’t include Madison County (DEQ contact list), so plans go to the state Land Quality staff at the Asheville regional office. The trigger is the state one: 1 acre of disturbance, plan filed at least 30 days before work, forestry under best management practices and normal farming exempt (DEQ erosion rules). The state fee is set by DEMLR and posted with the application (DEQ application page). We don’t quote it from memory because it changes with the budget.

Under an acre, nothing files, and the 21 day ground cover clock still runs. A Mars Hill pasture edge under an acre is a mulch job with no permit. The same edge with a driveway cut that pushes past an acre is a plan. Our permit guide walks the state form.

What does the ridge ordinance add?

A permit on tall buildings. It says nothing about clearing. Madison’s Mountain Ridge Protection Ordinance covers protected ridges at 3,000 feet elevation or higher that stand 500 feet or more above the adjacent valley floor, and it requires a permit before a building over 40 feet goes up on one (county ordinance). It sets no slope percentage. Madison County has not published a steep slope threshold for grading, so on a Bald Mountain bench we design the pad to the state cut and cover rules and ask county planning about the ridge line (Madison County).

Burning and the trout strip

Open burning needs an NC Forest Service permit through the Madison County ranger, and land-clearing debris on more than 5 contiguous acres needs the special permit (NC Forest Service permits). Madison burns more than the counties closer to Asheville because the lots are bigger and the neighbors are farther. Our burn permit guide has the hours and setbacks. Big Laurel, Spring Creek, and the Shelton Laurel drainages carry designated trout water, so the 25 foot strip from top of bank applies on a lot of Madison creeks. Where Helene still shapes the work

The French Broad took Marshall’s riverfront. Madison was the last county in the region to open private property debris sign-up, on March 11, 2025, through a state-contracted program with registration days at the Mars Hill and Marshall libraries and the Hot Springs community center (WLOS, March 11, 2025). The state SMART program lists Madison County on its roster as of this page’s date (SMART roster), so registered parcels may still get crews.

Ground and access across the county

Old homestead ground. Mars Hill sits on rolling benches that take a wheeled truck and make good pasture reclamation work. Drop toward the French Broad at Marshall or climb toward Hot Springs and the roads turn to one-lane gravel with no turnaround, and the equipment goes to tracks. Most Madison calls are forestry mulching on overgrown fields, driveway corridors into tracts that have not been farmed in a generation (driveway and access road clearing), and creek cleanup. South-facing benches on the Mars Hill side are the food plot ground.

Is Helene debris still getting hauled in Madison County?

Registered parcels may still see crews. Madison opened its state-contracted private property debris sign-up on March 11, 2025, with registration days at the Mars Hill and Marshall libraries and Hot Springs, and the state SMART program lists Madison County on its roster. Wood that never went on a list is a private job. Marshall's riverfront still has it. Get a landfill ticket from whoever hauls.
