Public waterway removal finished at about 1.29 million cubic yards. Buncombe right-of-way removal finished April 2025 at about 1.01 million cubic yards. Those numbers are why the street looks done and the creek bank on your side doesn’t.

Buncombe’s Reduce to Rebuild waived permit fees, with about 400 permits by mid-2026. Fee waiver isn’t hauling. If you’re rebuilding, you may still need the lot opened so trucks can enter. That opening is clearing.

What rules still apply when you finally clear the pile?
Erosion paper still follows disturbance. North Carolina wants a plan for land-disturbing activity of 1 acre or more, filed at least 30 days before work. Unincorporated Buncombe follows that 1-acre line. Asheville’s delegated program starts a formal plan at 10,000 sq ft. If you’re only picking wood and leaving soil in place, you may never hit it. If you grub a pad in the same pass, you might.
Trout waters still get a 25 ft undisturbed buffer from the top of bank. Helene did not repeal that. A machine that follows the flood scar into the strip is still in the strip.
Federal nexus work (FEMA funding, Army Corps permits) that may affect northern long-eared bat avoids clearing suitable roost trees April 1 through November 14. A purely private pile with no federal permit usually doesn’t sit in that window. A funded rebuild might. Ask before you schedule a summer take-down on a lot that still has a federal file.
Drying downed timber is also fuel. Wildfire risk from Helene’s downed trees is that follow-on. Wildfire mitigation and defensible space is the home-ignition work. Where a slope failed, walls and slope stabilization are a grading contractor’s crew, not a grapple truck.
How do you start On a Swannanoa lot in 2026?
